General Terms and Conditions (GTC)

1. General

No terms and conditions other than those stated below are binding between you (the “Customer”) and ibex-outdoor.com (the “Seller”), unless other terms are expressly stated in writing by an authorized representative.

2. Acceptance

The General Terms and Conditions written herein apply to customers purchasing products or services from ibex-outdoor.com. Please read the following information carefully before purchasing a product. By making a purchase, you (the Customer) confirm that 1) you have read the General Terms and Conditions and 2) you agree to be bound by them. These terms may be changed at any time without prior notice.

3. Purchase of Products and/or Services

Products from Alpinhunting are offered for sale subject to availability. By making a purchase, the Customer agrees to provide the Seller with all relevant information, including credit card details (if applicable) required to complete the transaction and payment for the products and/or services. Goods may, of course, be tried on and inspected as they would be in a physical retail store.

4. Prices

Prices are stated in Euro and include the statutory value-added tax (VAT). All prices are quoted excluding delivery costs. (See Article 6 for delivery costs). Catalog prices are subject to change without notice.

5. Payment Methods

Alpinhunting accepts customer payments for products and services via the following methods:

  • Prepayment (Bank Transfer)
  • Cash on Delivery (COD)
  • Credit Card: We accept Visa. When paying by Visa, the Seller will add relevant expenses (e.g., delivery costs). The credit card holder must be the same person named on the card (cardholder and account owner).
  • Invoice: The invoice amount is due immediately upon receipt of the goods. We reserve the right to exclude this payment method after credit assessment.
  • PayPal: PayPal account holders can shop conveniently and easily using this payment method.

In individual cases, we reserve the right to order and deliver goods only after receiving a down payment. This applies particularly to the ordering of goods from our suppliers that are not part of our standard range.

6. Delivery and Shipping Costs

Deliveries generally take place from stock and within two working days. If delivery times exceed one week, the expected delivery time will be communicated. For orders up to a value of €1,000.00, we charge a €10.00 flat shipping fee within the EU. For orders over €1,000.00, shipping is free of charge. For bulky goods, we charge a flat fee of €35.00. Deliveries to countries outside the EU (e.g., Switzerland) are processed net (excluding VAT). Please inquire for shipping costs to countries outside the EU.

7. Retention of Title

The Seller retains ownership of the delivered goods (reserved goods) until all claims held by the Seller against the Buyer, for any legal reason now or in the future, have been fulfilled. The Buyer may not dispose of the reserved goods. In the event of access by third parties—specifically bailiffs—to the reserved goods, the Buyer shall point out the Seller’s ownership and notify the Seller immediately. In the event of a breach of contract by the Buyer—particularly default of payment—the Seller is entitled to demand the return of the reserved goods after withdrawing from the contract.

8. Limited Warranty and Liability

If the delivered item is defective or lacks the agreed quality, the Buyer may choose between rectification of the defect or a new delivery (supplementary performance). In the case of supplementary performance, the Seller shall bear the necessary expenses. The admissibility of the choice depends on proportionality. The Seller may refuse the type of supplementary performance chosen by the Buyer if it involves disproportionate costs. See Articles 9 and 10 for additional information.

Liability claims against the operator relating to material or non-material damage caused by the use or non-use of the information provided, or by the use of incorrect or incomplete information, are generally excluded, provided there is no demonstrable intentional or grossly negligent fault on the part of the operator. See Article 12 for additional information.

9. Damage, Defects, or Missing Items

Should delivered items show obvious material or manufacturing defects, including transport damage, please report such defects immediately to us or to the carrier. In addition to the statutory warranty, the specific warranty conditions attached to each item shall apply. We are prepared to recognize warranty claims from our customers provided they are made in a timely manner, allowing us to pass these claims on to our suppliers within their respective deadlines. (Provisions regarding supplementary performance from Article 8 also apply here).

10. Exchange and Returns

Exchanges or returns of goods are possible. Please contact us as soon as possible (e.g., by letter or email) so that we can arrange for a replacement product. Delivery dates or deadlines for exchanges or returns, whether binding or non-binding, must be agreed upon in writing. In the event of delivery delays for which we are responsible, the statutory grace period to be set by the customer is fixed at 2 weeks, beginning upon the Seller’s receipt of the notice. Goods that have already been used cannot be refunded or exchanged, or can only be refunded with a deduction for loss of value.

11. Breach of Contract

In the event of a breach of contract by the Buyer (e.g., default of payment), the Seller is entitled to withdraw from the contract and demand the return of the reserved goods. In this case, the Customer shall bear all costs incurred for the returned items.

12. Website and Catalog Content

The operator assumes no liability for the topicality, correctness, completeness, or quality of the information provided. All offers are subject to change and non-binding. The operator expressly reserves the right to change, supplement, delete parts of the pages or the entire offer without separate announcement, or to cease publication temporarily or permanently.

13. Copyright

This website is protected by copyright. All brands, logos, images, and texts on this website are also protected by copyright. The reproduction, distribution, modification, or unauthorized use of this website and its contents is prohibited without prior written consent from Alpinhunting. All rights reserved.

14. Invalidity and Severability Clause

All rights and restrictions contained herein may be exercised and shall be binding only to the extent that they do not violate applicable laws. They shall be limited as necessary to make this agreement legal, valid, and enforceable. If any individual provision of these General Terms and Conditions is determined to be invalid by a competent court, this shall in no way affect the validity of the remaining provisions.

15. Privacy and Data Protection

Data required for processing a transaction and useful for maintaining customer relationships are the property of the Seller.
